We stand behind our product with this limited warranty, which covers Lightship electric RVs sold in the United States (“Limited Warranty”).

Overview

Under this Limited Warranty, Lightship Energy Inc. (“Lightship”, “we”, “us”, “our”) provides certain warranties related to your Lightship RV against defects in materials and workmanship under Normal Use Conditions for the applicable Warranty Period.  This Limited Warranty explains your rights and remedies and our obligations to repair your Lightship RV during the applicable Warranty Period.  Please read it carefully as it contains exclusions and limitations that affect your rights.

For your future reference, we recommend that you print or save a copy of this Limited Warranty.  

IMPORTANT:  If you resell or transfer ownership of your Lightship RV (e.g., you gift it to someone else), you MUST release the VIN number for the Lightship RV you are selling or transferring so that we can ensure that the new owner has the benefits of the Limited Warranty for the remainder of the Warranty Period. We also ask that you deliver a copy of this Limited Warranty and User Manual to the new owner.

What Definitions Apply?

  • Authorized Retailer” means Lightship Energy, Inc. and any other dealer of Lightship Energy Inc. that is located in the United States.
  • Battery” means the high voltage battery installed in your Lightship RV.
  • Covered Product or Component” means any of the Lightship RV and Battery components described under the “Which Lightship Products and Components are Covered?” section, below.
  • Lightship RV” means a new Lightship electric RV originally purchased from an Authorized Retailer. Any test ride, demonstration, and promotional models of our RVs will not constitute a Lightship RV subject to the terms of this Limited Warranty.
  • Normal Use Conditions” means ordinary consumer use of your Lightship RV in accordance with the instructions provided by an Authorized Retailer to you, including but not limited to the User Manual as well as other instructions and notices provided in connection with the purchase of the Lightship RV from an Authorized Retailer and/or otherwise from time-to-time during the Warranty Period.
  • Subsequent Owner” means any person other than the first retail purchaser of the Lightship RV  who lawfully assumes ownership of the Lightship RV after its first retail sale during the Warranty Period.
  • User Manual” means the user manual that is provided to you upon delivery of your Lightship RV, as it may be updated from time-to-time by Lightship.
  • Warranty Period” means the period during which Lightship makes the warranties contained herein with respect to the Lightship RV.  Different Warranty Periods apply to different components of the Lightship RV, as specified under the “When Does Warranty Coverage Begin and How Long Does it Last?” section, below.
  • You”, “your” means the consumer who bought the Lightship RV from an Authorized Retailer or any Subsequent Owner.

Who Makes This Limited Warranty?

This Limited Warranty is made by Lightship Energy, Inc., 1765 W. 160th Ave., BLDG 3, Suite 700, Broomfield, CO 80023. 

Which Lightship Products And Components Are Covered?

Any Lightship RV sold in the United States by an Authorized Retailer to the first retail purchaser of that RV.  

Specifically, during the applicable Warranty Period, this Limited Warranty covers the following components of your Lightship RV (each, a “Covered Product or Component”):

  1. General Parts Warranty: Lightship RV component parts, but excluding Battery and Drive Unit components.
  2. Battery Warranty:  the Battery and its components, including the battery management system and internal wiring components.
  3. Drive Unit Warranty: Lightship RV drive unit/powertrain, including electric motors and gearbox assembly. Interfaces that connect the RV systems to the drive unit (including but not limited to external cables, harnesses and hoses) are covered under the terms of the General Parts Warranty.

Who Can Enforce This Limited Warranty?

The first retail purchaser of the Lightship RV and any Subsequent Owner is entitled to the benefits of this Limited Warranty during the applicable Warranty Period. 

When Does Warranty Coverage Begin And How Long Does It Last?

This Limited Warranty starts on the date the new Lightship RV is originally delivered to its first retail purchaser and continues for the duration of the applicable Warranty Period† as specified herein:

• General Parts Warranty* - Three (3) Years**
• Battery Warranty and Drive Unit Warranty* - Five (5) Years**

* This Limited Warranty is unlimited in mileage.
** All warranty periods begin on the date of the first retail purchaser’s purchase.
† Because your Lightship RV is a fully-electric RV, it is not eligible for any emissions warranties.

If you are a Subsequent Owner, your coverage under this Limited Warranty commences on the date you lawfully assume ownership of the Lightship RV and will continue through the end of the applicable Warranty Period. 

In addition, if Lightship repairs or replaces a Covered Product or Component under this Limited Warranty, the repaired or replaced Covered Product or Component will continue to be warranted for the remaining time of the applicable original Warranty Period or for three (3) months from the date of the repair or replacement, whichever is longer. Any repairs performed pursuant to the terms of this Limited Warranty must be performed by an authorized Lightship repair facility in the United States.  

Any part replaced under the terms of this Limited Warranty becomes the property of Lightship. If we replace a Covered Product or Component (or part thereof), we will not return to you the original Covered Product or Component that was replaced.

What Are Your Remedies Under This Limited Warranty?

If a defect in a Covered Product or Component arises and a valid claim is received by Lightship within the applicable Warranty Period, Lightship will, at its option and to the extent permitted by law, either repair or replace the Covered Product or Component found to be defective in material or workmanship, when used under Normal Use Conditions, free of charge. In determining whether a repair or replacement is appropriate, Lightship will take into consideration, among other things, the nature of the defect of the Covered Product or Component and your stated preferences.  Repair or replacement may, at Lightship’s option, involve the use of reconditioned or refurbished parts functionally equivalent to new ones, unless prohibited by applicable law.

How Do You Get Warranty Repairs Or Service?

To be eligible for a warranty service hereunder, you must submit a warranty claim during the applicable Warranty Period. To the maximum extent permitted by applicable law, if we determine that, based on the submitted warranty claim form, it is necessary for the Lightship RV (or other Covered Product or Component) to be brought into an authorized Lightship repair facility for warranty service, we will give you instructions on how to deliver your Lightship RV (or other Covered Product or Component) to the authorized facility.

Once Lightship or its authorized representative receives your Covered Product or Component for warranty service, Lightship or an authorized party will determine if it has a defect or malfunction covered by this Limited Warranty. If Lightship determines that the claim is justified based on this Limited Warranty, Lightship will repair or replace the defective Covered Product or Component as specified in the “What are Your Remedies under this Limited Warranty?” section above.

Please note that determining the defect or malfunction and carrying out the warranty service may take longer in some cases, depending on the features and components of the Covered Product or Component affected.

What Are Your Responsibilities?

Please read the User Manual carefully prior to operating your Lightship RV. We may update the User Manual from time-to-time, e.g., due to new functionalities being introduced. We will also notify you of such updates. 

We also recommend that you follow the maintenance program provided in the User Manual, including but not limited to, by conducting inspections on your RV once per year and following proper battery maintenance procedures set forth in the User Manual.

It is on your responsibility to pass on the User Manual, safety warnings and this Limited Warranty in the event the Lightship RV is sold, gifted, or otherwise transferred to someone else.

What Is Covered By This Limited Warranty?

General Warranty (Parts, Battery and Drive Unit)

Lightship warrants that each Covered Product or Component will be free from defects in materials and workmanship under Normal Use Conditions for the applicable Warranty Period.  In the event any such defect is detected and reported to Lightship during the applicable Warranty Period, Lightship agrees to repair or replace the Covered Product or Component subject to the terms set forth herein. 

Battery Warranty

The Battery capacity naturally decreases overtime with use. This expected gradual capacity loss over time is not covered under the Battery Warranty.  However, greater than expected degradation is covered under the Battery Warranty. Lightship warrants that the Battery will retain 70% of Battery nameplate* usable capacity under Normal Use Conditions for the applicable Warranty Period.

*Nameplate usable capacity refers to the maximum amount of energy a battery or energy storage device can actually provide under normal operating conditions.

For warranty claims specific to Battery capacity, the replacement Battery will be in a condition appropriate to the age and mileage of the vehicle sufficient to achieve or exceed the minimum Battery capacity for the remainder of the warranty period of the original Battery.  Note that the vehicle’s range estimates are an imperfect measure of Battery capacity because they are affected by additional factors separate from Battery capacity.  The measurement method used to determine Battery capacity, and the decision of whether to repair, replace or provide reconditioned or re-manufactured parts, and the condition of any such replaced, reconditioned or re-manufactured parts, are at the sole discretion of Lightship.

What Is NOT Covered By This Limited Warranty?

Software and Other Products. This Limited Warranty does not apply to, and the term “Covered Product or Component” will not include, any software, even if packaged or sold with a Covered Product or Component or embedded in a Covered Product or Component (e.g. firmware and/or system software) (“Lightship Software”) or to any other product required to use a Covered Product or Component that is not installed on, or otherwise included in, a Covered Product or Component  at the time of the original retail purchase (“Other Product”). Any license to use Lightship Software is set out in the Lightship System Terms of Use that accompanies such software. Other Products are subject to other terms, even if intended or labelled to be used together with the Lightship RV.

Damage or Malfunction Outside of Coverage. This Limited Warranty does not apply if the applicable Warranty Period has expired or if the Covered Product or Component is not used in Normal Use Conditions and in accordance with the terms of this Limited Warranty. To the extent permissible under applicable law, Lightship Energy used as demonstrator, test, or promotional vehicles are not covered by this Limited Warranty.

Damage Caused By Misuse, Abuse, or Improper Maintenance. This Limited Warranty does not cover, and Lightship is not responsible under this Limited Warranty for damage to, or malfunctions in, any Covered Product or Component, or for any loss or deterioration of them resulting from any of the following:

  • use and maintenance not in accordance with Normal Use Conditions;
  • any other misuse, neglect, or abuse of the Covered Product or Component, including, without limitation use of the Lightship RV for off-road use, racing or competition of any kind;
  • an accident (e.g., fire, accidental physical impact, collision, fall, crash, etc.), theft or improper storage;
  • use against any express instructions provided by Lightship;
  • using the vehicle for purposes other than those for which it was designed;
  • a continued use of the Covered Product or Component after a warning light is displayed or other notice indicating a mechanical or operational problem is delivered;
  • failure to maintain or store the Covered Product or Component in accordance with the instructions in the User Manual (including any failure to maintain the Battery charge as instructed);
  • installation or use of any charger not approved by Lightship or meeting the specifications approved by Lightship for the Covered Product or Component;
  • running without factory certified fluids;
  • commercial use (such as taxi and delivery services), law enforcement, military, government, or professional use (such as professional or hobby racing and driving learning/training days on and off a racetrack);
  • reckless driving of the vehicle including but not limited to curbs, potholes, debris, vegetation, or other obstacles; or
  • damage caused by snow traction devices.

Damage Caused by Alteration or Modification. This Limited Warranty does not cover, and Lightship is not responsible under this Limited Warranty for damage to, or malfunctions in, any Covered Product or Component, or for any loss or deterioration of them resulting from:

  • use of equipment installed on the Covered Product or Component in violation of any laws, regulations, or ordinances in effect in the jurisdiction where the Lightship RV is used or registered;
  • improper repairs, modifications, or adjustments made by parties other than Lightship or Authorized Retailers;
  • installation or use of components not meeting the specifications approved by Lightship, including but not limited to, tires, suspensions, electric components, aftermarket components, etc.;
  • unauthorized removal, alteration or reprogramming of a Covered Product or Component, including the Battery, stock components or software affecting the designed performance, functionalities or protection; or
  • unauthorized opening or attempted opening of the Battery (the Battery is not considered customer serviceable component and should not be attempted to be opened).

Damage Caused by Environment or Normal Use. This Limited Warranty does not cover cosmetic damages (such as scratches), rust, pitting, corrosion, fading of paint and colors, peeling and detachment of paint work, labels, and stickers that are caused by normal use or by exposure to environmental conditions, abuse, or improper maintenance. This Limited Warranty also does not cover damage caused by:

  • acts of God, such as lightning, flood, tornado, earthquake or hurricane or other circumstances outside Lightship’s control; or
  • exposure to excessive surrounding temperatures or extreme weather conditions causing accelerated battery cell capacity degradation, including without limitation, storing the vehicle at temperatures below 14 degrees Fahrenheit/-10 degrees Celsius without being plugged into a charger.

Normal Maintenance and Wear. Furthermore, this Limited Warranty does not cover, and Lightship is not responsible for, parts and labor required for routine maintenance of the Lightship RV and the replacement of parts due to normal wear and tear. You are responsible for those items, including, but not limited to, tires, brake pads and rotors, bearings and gaskets.

Data Loss. No data loss is covered by this Limited Warranty. You are solely responsible for backing up regularly your data, electronically or physically if you wish to retain your data. No loss, damages, loss of profit or costs in respect of data recovery, removal or installation are covered under this Limited Warranty. 

Issues Not Covered by This Limited Warranty. 

In addition, this Limited Warranty does not cover any of the following:

  • Glass, including windshield glass, that is cracked, chipped, scratch, or otherwise broken by any means besides a defect in material or workmanship;
  • Normal noise, vibration and harshness, including but not limited to, brake noise, road noise and vibration and general creaks, squeaks and rattles; and
  • Certain individual items associated with the vehicle, including, but not limited to, the tires, external charging equipment or related non-vehicle components that have separate warranties subject to their own terms and conditions.

Are There Any Other Limitations With Respect To This Limited Warranty?

This Warranty is subject to the following limitations and disclaimers:

DISCLAIMERS AND IMPLIED WARRANTIES AND CONDITIONS

LIGHTSHIP DOES NOT WARRANT THAT THE OPERATIONS OF THE COVERED PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.  EXCEPT FOR THE EXPRESS LIMITED WARRANTY PROVIDED HEREIN, LIGHTSHIP DISCLAIMS ALL OTHER EXPRESS WARRANTIES OF ANY KIND. IN ADDITION, EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES AND CONDITIONS (INCLUDING WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) WILL BE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.  

SOME STATES DO NOT ALLOW LIMITATIONS ON THE DURATION OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.  

LIMITATIONS ON LIABILITY

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, NEITHER LIGHTSHIP NOR ITS AUTHORIZED RETAILERS SHALL BE RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGES, OR LOSS OF PROFIT TO YOU RELATING TO ANY COVERED PRODUCT OR COMPONENT AND/OR THIS WARRANTY, INCLUDING, BUT NOT LIMITED TO, COSTS OF TRANSPORTATION TO AND FROM A LIGHTSHIP SERVICE CENTER, LOSS OF VEHICLE VALUE, LOSS OF TIME, LOSS OF INCOME, LOSS OF USE, LOSS OF PERSONAL OR COMMERCIAL PROPERTY, INCONVENIENCE OR AGGRAVATION, COMMERCIAL LOSS (INCLUDING BUT NOT LIMITED TO LOST PROFITS OR EARNINGS), TOWING CHARGES, BUS FARES, VEHICLE RENTAL, SERVICE CALL CHARGES, GASOLINE EXPENSES, LODGING EXPENSES, DAMAGE TO TOW VEHICLE, AND INCIDENTAL CHARGES SUCH AS TELEPHONE CALLS, FACSIMILE TRANSMISSIONS, AND MAILING EXPENSES. THE ABOVE LIMITATIONS AND EXCLUSIONS APPLY WHETHER YOUR CLAIM IS IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND GROSS NEGLIGENCE), BREACH OF WARRANTY OR CONDITION, MISREPRESENTATION (WHETHER NEGLIGENT OR OTHERWISE) OR OTHERWISE AT LAW OR IN EQUITY, EVEN IF LIGHTSHIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE REASONABLY FORESEEABLE.

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, THE REMEDIES AVAILABLE TO YOU UNDER THIS LIMITED WARRANTY, AND THE LIABILITY OF LIGHTSHIP AND ITS AUTHORIZED RETAILERS WITH RESPECT TO CLAIMS ARISING UNDER THIS LIMITED WARRANTY WILL NOT EXCEED THE PRICE OF THE COVERED PRODUCT OR COMPONENT ON WHICH SUCH LIABILITY IS BASED.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Voided Warranty

Complying with the User Manual and any future field service action notifications for your vehicle is important to maintain warranty coverage. This Limited Warranty may be voided if the instructions in those documents, or possible future field service actions, are not followed. These instructions include, but are not limited to, compliance with field service action notifications, vehicle proper user, vehicle repair and maintenance requirements and software updates.

As with proper operation and maintenance of your vehicle, Lightship is not responsible for you receiving and maintaining your vehicle’s maintenance and service records. Detailed records must include the service center location or mobile service identification number, service dates, description of services, and the full 17-digit vehicle identification number (VIN). Transferring any maintenance or service records should the vehicle be resold is not Lightship’s responsibility.

The following events may also void the Limited Warranty:

  • Abuse or neglect that interferes with the proper functioning of the vehicle;
  • VIN defacing or alterations;
  • Odometer modifications or disconnections;
  • Vehicles that have been determined to be dismantled, fire damaged, flooded, salvaged or a total loss.
  • Damage to your vehicle due to towing that was not pre-authorized by Lightship customer service.

Except as described herein, taking your vehicle to be serviced by a repair shop that is not a Lightship authorized repair facility will not void this Limited Warranty, and using third-party parts alone will not void this Limited Warranty.  However, Lightship will exclude warranty coverage for defects or damage caused by unauthorized parts, service, or use of the vehicle (including defects or damage caused by use of aftermarket parts or use of the vehicle for racing or competition). The denial of coverage may be based on the installation of parts designed for unauthorized uses of the vehicle. Lightship recommends that all maintenance, service and repairs be done at an authorized Lightship repair facility.

What Else Do I Need To Know About This Limited Warranty?

Many States have laws, sometimes called “lemon laws,” that provide consumers with rights under certain circumstances if they have problems with their new vehicles. These laws vary from State to State, and a number of them cover RVs. If any such State law applies to your Lightship RV, then to the fullest extent permitted under applicable law, Lightship requires that you first notify us in writing of any defects or service difficulty that you may have experienced with your Lightship RV within a reasonable time to allow us an opportunity to make any needed repairs before you pursue any remedy under applicable State law.

In your notice, please include the following information:

  • Your name and contact information;
  • VIN of the Lightship RV;
  • Name and location of the Lightship dealer or authorized Lightship repair or service facility nearest you;
  • Current mileage;
  • Description and photo/video (to the extent applicable) of the defect; and,
  • History of the attempts you have made with a Lightship dealer or authorized Lightship repair or service facility to resolve the concern, or of any repairs or services that were not performed by an authorized Lightship repair or service facility.

  • No person or entity (including an Authorized Retailer) is authorized to make any other warranties or representations on behalf of Lightship. No Lightship employee or representative, Lightship’s affiliates, Authorized Retailers or any third party is authorized to make any modification, extension or addition to this Limited Warranty or any part of these terms.
  • The laws of the State where you live (or, if a business, where your principal place of business is located) govern the interpretation of this Limited Warranty, claims for breach of it, and all other claims (including consumer protection, unfair competition, implied warranty, and tort claims), regardless of conflict of laws principles, except that the Federal Arbitration Act governs all provisions relating to arbitration.
  • This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
  • Any disputes between you and Lightship related to this Limited Warranty or a Covered Product or Component will be governed by the then-current dispute resolution procedures in Lightship’s Terms of Sale that accompanied your purchase.  
  • If any term of this Limited Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms will not be affected or impaired.

Any appliances that come with your new Lightship RV may be warranted by their manufacturer.  Limited warranty details for a particular appliance are detailed in the applicable appliance manufacturer’s limited warranty statement found on their website.
